Consumer - We know that the average consumer bankruptcy case involves good people in trouble. We have represented
consumer debtors since 1982. We offer a straight forward fixed fee program which fits the needs of the majority of consumer
debtors in the Montgomery/Harris County areas. Most consumer debtors qualify for this fixed fee program. Please
contact our office to inquire about fees. See our page on Consumer Bankruptcy Fixed Fee Programs for more information.
Commercial - In the business world, there are few things as repugnant to a business owner as the prospect of
Bankruptcy. This is so true, that many businesses will be run into the ground before their owners realize that Bankruptcy
exists not just to get them out of business or shut down but, rather, Bankruptcy exists to help reorganize businesses so that
they can continue to play a role in our economy. It is the only system that exists to help return businesses to health.
As such, Bankruptcy plays an important role in our national economy. We have over 25 years of experience working with
small to medium businesses in trouble. We have designed non-bankruptcy work outs, bankruptcy reorganizations, and orderly
liquidations. Our clients have included companies with $2mm to $64mm in sales. We have represented manufacturers,
distributors, retailers, service shops, auto dealers, doctors, dentists, lawyers, restaurants, fanchisees, developers, media
companies and content providers in venues from coast to coast. We work with each business to find the source of the
trouble, design solutions, and then use the tools at our disposal to implement those solutions. What we do is apply
years of experience of working with failing businesses to help you adjust your business means, methods, and/or balance
sheet, to make the outcome work for you. All commercial bankruptcy cases are handled on an hourly fee basis.
The usual retainer for pre-bankruptcy investigation and issue determination is between $5,000.00 and $30,000.00. Any
unused balance of this retainer can be applied to an initial Bankruptcy engagement. Bankruptcy engagements are usually
begun with a retainer of $10,000 to $75,000 depending upon the complexity of the case. Once the Bankruptcy case is filed,
all further compensation is obtained only through permission of the Bankruptcy Court. Fees for a Chapter 7 Liquidation
usually do not exceed $10,000. Fees for a Chapter 11 Reorganization usually range between $25,000 and $200,000 depending
upon the case. Of course, every case is different and fees vary with complexity, adversity, and amount of time devoted
to the case. Creditors - We provide creditor representation in bankruptcy cases as well. We handle complex
litigation, adversary proceedings, and motion hearings in bankruptcy courts to assist creditors in obtaining the best outcome
possible given the environment forced upon them by the Bankruptcy, or in the case of an involuntary filing, by the insolvency
of the Debtor. We have represented Banks, private mortgage companies, private lenders, auto lenders and pay check companies
in recovering from debtors in Bankruptcy. We have represented creditors with claims as small as a few thousand
dollars to as large as over $4mm. We are proud members of the American Bankruptcy Institute.
